Effective 2026-11-06. These terms govern the Opening Soon PRO subscription ("the Service") provided by Opening Soon PRO ("we", "us").
The Service is a periodic compilation of publicly available information about food and drink businesses that appear to be opening, relocating or changing in a metropolitan area: licence and permit filings, published press, and information the businesses publish about themselves. It is provided for business-to-business sales and market research use.
The Service is provided "as is" and "as available". We do not warrant that any listed business will open, open on any date, or exist; that any address, name, contact detail or description is accurate, current or complete; or that the Service will be uninterrupted or error-free. Public records contain errors and businesses change plans. You are responsible for verifying anything you act on.
You may use the information to inform your own business development. You are solely responsible for how you contact any business or person listed, and for complying with all laws that apply to your outreach, including telephone, email and marketing laws (for example CAN-SPAM, the TCPA and state do-not-call rules) and any industry rules that apply to you. We make no representation that any listed business or person consents to be contacted.
A subscription is a licence for one company (the subscriber) and its employees to use the sheets internally. You may not resell, sublicense, publish, scrape, or redistribute the Service or any substantial part of it, bundle it into another product or data set, or share access links outside your company. We may suspend access for violations.
Facts drawn from public records are not owned by anyone. Our selection, arrangement, research notes and presentation are ours. Press items are linked, not reproduced. Trademarks and names of listed businesses belong to their owners; their appearance here is not an endorsement by them or of them.
Subscriptions bill monthly in advance through Stripe and renew automatically until cancelled. You can cancel at any time from the link in your receipt email or by emailing us; access continues to the end of the paid period. Fees are non-refundable except where the law requires otherwise. We may change prices with 30 days' notice by email. Free trials end automatically unless you subscribe.
We may add, change or remove metros, fields, formats and delivery methods. If we discontinue a metro you pay for, we will refund the unused portion of the current month for that metro.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue, data or business opportunities, arising from the Service or your use of it, even if advised of the possibility. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
You will indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your use of the Service or your outreach to any business or person listed in it.
A business that wants its listing corrected or removed can email us; we will act within ten business days. Public filings themselves remain public.
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Ohio, and each party consents to their jurisdiction. If any provision is unenforceable, the rest remains in effect.
We may update these terms; the effective date above changes when we do, and continued use after a change is acceptance. Material changes are announced by email to subscribers.
